My child was injured in a retail store, can I recover damages on behalf of my child?

As the guardian or parent of a child once the court recognizes you as a representative, and there’s a process by which you are recognized as a representative, then you can file a claim on behalf of that child and get recovery for their injuries. We tell folks all the time that you need to be aware of statutes of limitations for cases like that. The laws in all the states I’m aware of, you know you don’t have just, one or two years or three years after that after the injury. That child’s claim could be valid and exist up to the time they’re 18, maybe even 18 plus one two or three years. So, that’s important because a young child could be injured and you really don’t know the long term effect of that injury on that child. So, it’s important to come in to see a lawyer, figure out how much time you have to protect that child’s interests which is what you’re supposed to do.
