How much time do I have to report an injury on a work site?

What I tell folks is there is no specific deadline on how long you have to report an incident where there’s been an injury on a construction site, but I will tell you please report it as quickly as possible. A lot of folks don’t realize that there are a very limited number of OSHA Inspectors in any state and they do not inspect or investigate every injury that occurs on a site. In some states they are limited to investigating deaths and catastrophes and a catastrophe is defined as three or more people going to the hospital. So you could literally lose your arm in a construction site and OSHA would not investigate that case unless they’re notified of it. So, if you do believe that you’ve been harmed on a construction site as a result of the company violating workplace safety standard, report it as soon as possible. It needs to be investigated while the facts fresh, while the witnesses still remember things and certainly as OSHA creates that record, it’s a record that we could use if you come to see us the Bailey Javins & Carter. We can then issue a FOIA (Freedom of Information Act) request, get those investigation materials from OSHA and use those to prosecute your claim for the injuries you suffered. So please report it as soon as possible so that it can be investigated.
